New Zealand Society of Conveyancers

 

The Lawyers and Conveyancers Act 2006 ('LAC') came into force on 1 August 2008.

The purpose of the legislation is (amongst other things) to maintain public confidence in the provision of conveyancing services and to establish the new profession of conveyancing practitioner.  The legislation establishes a New Zealand Society of Conveyancers to control and regulate the conveyancing profession in New Zealand and to enforce the provisions of the LAC Act (and any regulations and rules made under it).


Constitution and rules

The New Zealand Society of Conveyancers must have a constitution, practice rules and rules providing for the registration of conveyancers.

The constitution and the rules (as approved by the Minister of Justice) must be submitted by the Council of the New Zealand Society of Conveyancers ("the NZSC Council") to the Registrar of Companies for registration by 14 August 2008.

The Minister of Justice ("the Minister") can amend the rules if necessary, after consultation with the NZSC Council and any other persons or groups as the Minister thinks fit.

There are no annual filing obligations with the Registrar of Companies.  The Minister will instead present the annual report of the New Zealand Society of Conveyancers to the House of Representatives.


Filing obligations

The NZSC Council is required to file:

1. Constitution amendments
Section 88(2) | A copy of any amendment to the constitution or a new constitution must be filed no later than 14 days after the passing of the amendment or the replacement of the constitution.

2. Amendments to the practice or registration rules
Section 105(1) | A copy of any amendment to the rules or new rules (as approved by the Minister) must be filed no later than 14 days after the amendment is passed or the existing rules are revoked.


The Minister is required to file:

Section 105(2) | If the practice rules are amended by the Minister under section 104, the Minister must file a copy of that amendment within 14 days after making the amendment.

Other Registers Search

The Companies Office website contains information on a range of other entities.

An Other Registers Search locates other registered entities using either the name or number.  This search will locate the organisations that are currently registered as well as those that have been removed from the register.

There are two options available to you for conducting an search of the other Registers - Other Registers Search and Previous Name Search.  Searching is easy and all information is FREE.

  • An Other Registers Search allows you to locate a registered organisation using the name, registered number or keywords.  This search will locate the organisations that are currently registered as well as those that have been removed from the register (struck off). 
  • A Previous Name Search allows you to locate a registered organisation using a previous name (if the name was changed after 1 July 2006).
